Thank you for shopping with ShopVimocity.com. We care about creating a clear, supportive, and reliable experience for every customer who purchases products through our store.

These Store Terms & Conditions (“Store Terms”) apply only to physical products purchased directly through ShopVimocity.com, the consumer online store operated by Vimocity, Inc. (“Vimocity,” “we,” “us,” or “our”). They do not apply to vimocity.com generally, Vimocity’s workforce readiness platform, software services, training services, mobile app, web portal, enterprise programs, B2B customer agreements, master services agreements, order forms, subscription agreements, statements of work, data processing agreements, or any other written agreement between Vimocity and its customers.

These Store Terms are a separate, standalone agreement. They are independent of, and do not form part of, the terms of use, terms and conditions, customer agreements, or other terms that govern vimocity.com or the Vimocity B2B platform (together, the “Platform Terms”). The Platform Terms govern vimocity.com and the Vimocity B2B platform; these Store Terms govern only ShopVimocity.com. Neither set of terms modifies, replaces, or supersedes the other.

If you or your organization has a separate written agreement with Vimocity — including a customer contract, master services agreement, or the Platform Terms — that agreement governs the products and services it covers. If there is any conflict between these Store Terms and the Platform Terms or a Vimocity customer contract, the Platform Terms or customer contract control with respect to vimocity.com and the Vimocity B2B platform, and these Store Terms control only with respect to purchases made through ShopVimocity.com.

1. Overview

ShopVimocity.com allows customers to purchase physical products, tools, and related goods that support movement, recovery, workforce readiness, and personal well-being.

By placing an order through ShopVimocity.com, you agree to these Store Terms, our ShopVimocity.com Privacy Policy, Shipping Policy, and Return & Refund Policy, each available in the Shopify policy section of the Store.

If you do not agree to these Store Terms, please do not place an order through ShopVimocity.com.

General Supplement Disclaimer

These statements have not been evaluated by the Food and Drug Administration. These products are not intended to diagnose, treat, cure, or prevent any disease.

2. Store-Only Scope; Separate From the Vimocity Platform

These Store Terms apply only to purchases made directly through ShopVimocity.com. They do not apply to:

Vimocity’s workforce readiness platform
vimocity.com generally
Vimocity software or subscription services
Vimocity’s mobile app, web portal, or customer platform
Enterprise training services or programs
The Platform Terms — the terms of use, terms and conditions, and customer agreements that govern vimocity.com and the Vimocity B2B platform
B2B customer contracts, master services agreements, order forms, statements of work, and data processing agreements
Custom, bulk, enterprise, or negotiated purchases, unless expressly stated

For clarity, purchasing a product through ShopVimocity.com does not create access to Vimocity’s software platform, training programs, enterprise services, or customer portal unless separately agreed in writing by Vimocity.

These Store Terms and the Platform Terms are separate agreements maintained for separate services. Agreeing to these Store Terms does not mean you have agreed to the Platform Terms, and agreeing to the Platform Terms does not mean you have agreed to these Store Terms.

3. Eligibility

To place an order through ShopVimocity.com, you must be at least 18 years old, or the age of majority in your jurisdiction, and able to enter into a binding contract. By placing an order, you confirm that you meet these requirements.

4. Product Information

We do our best to provide accurate product descriptions, images, pricing, availability, and related information. However, product details may change from time to time, and we do not guarantee that all product descriptions, images, pricing, inventory availability, or other store content will always be complete, current, or error-free.

If we discover an error in product information, pricing, availability, or order details, we may correct the error, cancel the order, issue a refund, or contact you for additional instructions.

5. Orders and Acceptance

When you place an order through ShopVimocity.com, you are making an offer to purchase the selected product or products. An order is not considered accepted until it has been confirmed and processed. Vimocity may accept or decline an order for reasons including, but not limited to:

Product availability
Payment issues
Suspected fraud or unauthorized activity
Incorrect pricing or product information
Shipping limitations
Partner-brand or supplier fulfillment issues
Operational or technical errors

6. Payment

Payment must be completed at checkout using the payment methods available through ShopVimocity.com. Prices are listed in U.S. dollars unless otherwise stated. Customers are responsible for any applicable taxes, shipping charges, duties, fees, or other costs shown at checkout or imposed by applicable law.

Vimocity does not store full payment card information. Payments may be processed by Shopify, Shopify Payments, or other third-party payment processors.

7. Shipping and Delivery

Shipping rates, available shipping methods, and estimated delivery timelines are shown at checkout. Shipping and delivery are governed by our separate Shipping Policy, available in the Shopify policy section of the Store.

Delivery dates are estimates only unless expressly stated otherwise. We will do our best to support customers if shipping issues arise, but delivery timing may depend on carriers, fulfillment providers, partner brands, weather, supply chain conditions, or other circumstances outside Vimocity’s control.

8. Shopify Collective and Partner-Fulfilled Products

Some products sold through ShopVimocity.com may be fulfilled and shipped directly by third-party partner brands, suppliers, or fulfillment providers, including through Shopify Collective. For partner-fulfilled products, the applicable partner brand or supplier may manage inventory, order processing, packaging, shipping, delivery updates, returns, exchanges, or other fulfillment activities.

Because partner-fulfilled products may be shipped by third parties, they may:

Ship separately from other items in your order
Have different processing or shipping timelines
Be subject to partner-brand inventory availability
Require coordination with the partner brand or supplier for returns, exchanges, replacements, or refunds

We want the customer experience to feel seamless and supported, even when a product is fulfilled by one of our trusted partners.

9. Returns, Exchanges, and Refunds

Vimocity offers a 30-day return policy for eligible products purchased directly through ShopVimocity.com. Returns, exchanges, and refunds are governed by our separate Return & Refund Policy, available in the Shopify policy section of the Store.

Some products may be ineligible for return or may be subject to product-specific return instructions, especially if fulfilled by a third-party partner brand, supplier, or Shopify Collective partner.

10. Damaged, Defective, or Incorrect Products

If your order arrives damaged, defective, or incorrect, please contact us within 14 days of delivery at admin@vimocity.com with your order number and photos of the item, packaging, and shipping label.

If approved, we will work with you and, where applicable, the partner brand or supplier to provide a replacement, exchange, refund, or other appropriate resolution. Our goal is to make it right whenever we reasonably can.

11. Product Use and Customer Responsibility

Products sold through ShopVimocity.com may include movement, mobility, recovery, wellness, fitness, or work-readiness-related tools. Customers are responsible for using products safely, appropriately, and in accordance with any product instructions, warnings, manufacturer guidelines, or recommendations.

Products sold through ShopVimocity.com are not intended to diagnose, treat, cure, or prevent any disease, injury, or medical condition. Product information provided through the Store is for general informational purposes only and is not medical advice, physical therapy advice, or a substitute for professional guidance.

If you have a medical condition, injury, pain, mobility limitation, or other health concern, consult a qualified healthcare professional before using any product. Stop using a product if you experience pain, discomfort, dizziness, numbness, or any adverse reaction.

12. No Professional Advice Through Store Purchases

Purchasing a product through ShopVimocity.com does not create a professional, clinical, medical, therapeutic, training, coaching, consulting, or enterprise services relationship with Vimocity. Any educational content, product descriptions, videos, usage suggestions, or related materials provided in connection with store products are for general informational purposes only.

13. Bulk, Corporate, or Enterprise Orders

Bulk, corporate, custom, wholesale, or enterprise product purchases may require separate written approval, pricing, payment terms, shipping terms, or contractual terms. Unless Vimocity expressly agrees otherwise in writing, these Store Terms apply only to standard purchases made directly through ShopVimocity.com. 14. Promotions, Discounts, and Gift Cards

From time to time, Vimocity may offer promotions, discounts, coupon codes, or special offers. Promotions may be subject to additional terms, expiration dates, product exclusions, quantity limits, or other restrictions. Vimocity may modify or cancel promotions at any time, subject to applicable law. Discounts and promotions generally cannot be applied retroactively to past purchases unless expressly stated.

15. Store Account and Customer Information

You agree to provide accurate, complete, and current information when placing an order. You are responsible for ensuring that your contact information, shipping address, billing information, and order details are accurate before submitting your order.

16. Third-Party Services

ShopVimocity.com may use third-party services, including Shopify, payment processors, shipping carriers, analytics providers, email or marketing tools, partner brands, suppliers, and fulfillment providers. These third parties may have their own terms, privacy policies, or practices. Vimocity is not responsible for third-party websites, platforms, services, or policies that it does not control.

17. Intellectual Property

All content on ShopVimocity.com, including text, graphics, logos, product descriptions, images, videos, designs, branding, and other materials, is owned by Vimocity or used with permission. You may not copy, reproduce, distribute, modify, display, sell, or use store content for commercial purposes without prior written permission from Vimocity.

18. Prohibited Uses

You agree not to use ShopVimocity.com for any unlawful, fraudulent, abusive, or unauthorized purpose. You may not:

Interfere with store operations or security
Attempt to gain unauthorized access to systems or data
Use the Store to submit false, misleading, or fraudulent information
Violate applicable laws or regulations
Resell products in a way that violates applicable law or any written restriction provided by Vimocity or the applicable partner brand

19. Disclaimer of Warranties

To the fullest extent permitted by law, products sold through ShopVimocity.com are provided “as is” and “as available,” except for any warranties expressly provided by Vimocity, the applicable manufacturer, partner brand, or supplier.

Vimocity does not guarantee that products will meet every customer’s individual expectations, results, needs, or intended uses. Some jurisdictions do not allow certain warranty disclaimers, so some of these limitations may not apply to you.

20. Limitation of Liability

To the fullest extent permitted by law, Vimocity will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to your use of ShopVimocity.com or products purchased through the Store.

To the fullest extent permitted by law, Vimocity’s total liability for any claim related to a store purchase will not exceed the amount you paid for the product giving rise to the claim. Nothing in these Store Terms limits any rights you may have under applicable consumer protection laws.

21. Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold harmless Vimocity, its officers, directors, employees, contractors, agents, affiliates, partners, suppliers, and service providers from claims, damages, losses, liabilities, costs, or expenses arising from your misuse of the Store, violation of these Store Terms, violation of applicable law, or misuse of products purchased through the Store.

22. Dispute Resolution

We care about customer experience and want to resolve concerns quickly and fairly. If you have a concern about an order, product, or these Store Terms, please contact us first at admin@vimocity.com so we can make a good-faith effort to resolve it informally.

If a dispute cannot be resolved informally, any claim arising out of or relating to these Store Terms, the Vimocity Shopify store, or any product purchased through the store must be brought only in the state courts located in Snohomish County, Washington, or the federal courts with jurisdiction over Snohomish County, Washington, unless applicable law requires otherwise. You and Vimocity agree that disputes must be brought only on an individual basis and not as a class, collective, consolidated, private attorney general, or representative action, to the fullest extent permitted by law. Nothing in this section prevents either party from bringing an individual claim in small claims court or limits any non-waivable rights under applicable consumer protection laws.

23. Governing Law

These Store Terms are governed by the laws of the State of Washington, without regard to conflict of law principles, unless applicable law requires otherwise.

24. Severability

If any provision of these Store Terms is found to be unlawful, void, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

25. Entire Agreement

These Store Terms (shopvimocity.com), together with the ShopVimocity.com Privacy Policy, Shipping Policy, and Return & Refund Policy, make up the entire agreement between you and Vimocity regarding your purchases through ShopVimocity.com, and supersede any prior agreements regarding the Store. They do not replace, modify, or supersede the Platform Terms or any separate written agreement between you or your organization and Vimocity regarding Vimocity’s B2B platform or other products or services.

26. Changes to These Store Terms

We may update these Store Terms from time to time. When we make updates, we will revise the “Last updated” date at the top of this page. The version posted in the Shopify policy section at the time of your purchase will generally apply to that purchase, unless otherwise required by law. By continuing to use the Store or place orders after changes take effect, you accept the updated Store Terms.
