This Privacy Policy explains how Vimocity, Inc. (“Vimocity,” “we,” “us,” or “our”) collects, uses, and discloses personal information in connection with ShopVimocity.com, our consumer online store, and its related content, features, products, and services (the “Store”).

The Store is operated by Vimocity, Inc. and is powered by Shopify, which provides the ecommerce platform that enables us to offer the Store to you. By using the Store, you acknowledge that you have read and understand this Privacy Policy.

Scope: This Policy Applies Only to ShopVimocity.com

This Privacy Policy applies only to personal information collected when you shop on, use, or contact us through ShopVimocity.com. It does not apply to anything else. Specifically, this Privacy Policy does not apply to:

The Vimocity B2B workforce readiness platform, the Vimocity marketing website at vimocity.com, the Vimocity mobile app, or the Vimocity web portal.
Purchases or interactions through any channel other than ShopVimocity.com, such as third-party marketplaces or retailers.
Any enterprise or business-to-business relationship with Vimocity.

Personal information processed through the Vimocity B2B platform, vimocity.com, the Vimocity app, or the Vimocity web portal is governed by the separate vimocity.com Privacy Policy and any applicable customer agreement — not by this Privacy Policy.

Purchases made through ShopVimocity.com are consumer retail transactions. They are separate from, and outside the scope of, any Vimocity enterprise agreement, master services agreement, order form, statement of work, or data processing agreement.

If there is any conflict between this Privacy Policy and a Vimocity customer contract or the vimocity.com Privacy Policy, the Vimocity customer contract and the vimocity.com Privacy Policy control. If there is a conflict between the Store’s Terms of Service and this Privacy Policy regarding personal information collected through the Store, this Privacy Policy controls.

Personal Information We Collect

“Personal information” means information that identifies or can reasonably be linked to you. It does not include information that is de-identified or aggregated so that it cannot reasonably be linked to you. Depending on how you use the Store, we may collect:

Contact details — name, billing address, shipping address, phone number, and email address.
Order and transaction information — items you view, add to your cart, purchase, return, exchange, or cancel, and your order history.
Payment information — form of payment and payment confirmations. Payment card details are collected and processed by Shopify and its payment processors; we do not store full payment card numbers.
Account information — if you create a Store account: username, password, preferences, and settings.
Communications — information you provide when you contact us about orders, products, shipping, returns, or support.
Device and usage information — IP address, device and browser type, and information about how you interact with the Store, collected through cookies and similar technologies.

We collect this information directly from you, automatically through the Store (including through cookies), and from Shopify and our service providers. The Store is not intended to collect “sensitive personal information” (such as government identifiers or information about health, race, or religion); please do not submit it to us.

How We Use Your Personal Information

We use personal information to:

Operate the Store — process orders, payments, shipping, returns, and exchanges; manage accounts; enable reviews; and send order and account notifications.

Improve and personalize the Store and your shopping experience.

Strictly necessary cookies — required for the Store to function, including the shopping cart, checkout, security, and account login. These cannot be turned off.

The Store does not use advertising or targeting cookies. ShopVimocity.com uses a cookie consent banner provided by Shopify, which lets you accept or manage non-essential cookies. You can also control cookies through your browser settings. Disabling strictly necessary cookies may prevent parts of the Store from working.

How We Disclose Personal Information

We may disclose your personal information for legitimate business, operational, and legal purposes, including:

Shopify — which powers the Store and enables checkout, payment, account, analytics, and related services.
Service providers — who perform services on our behalf, such as IT, payment processing, analytics, customer support, cloud storage, fulfillment, shipping, returns, and fraud prevention.
Brand and fulfillment partners — some products on the Store are fulfilled, shipped, supported, returned, or exchanged by third-party brand partners, including through Shopify Collective. When you order these products, we share limited order information — such as your name, shipping address, email, phone number, and order details — with the applicable partner as needed to fulfill your order.
Carriers and logistics providers — as needed to ship products and support deliveries, returns, and exchanges.
At your direction — when you choose to use features such as social media widgets, login integrations, or product reviews.

We Do Not Sell or Share Your Personal Information

Vimocity does not sell your personal information, and does not share it for targeted advertising or other cross-context behavioral advertising, as those terms are defined under applicable privacy laws. We do not process your personal information for targeted advertising.

If you visit the Store with a Global Privacy Control (GPC) signal enabled, we honor it as an opt-out preference where applicable. We do not currently respond to other “Do Not Track” signals.

Data Retention

We keep your personal information only as long as necessary for the purposes described in this Privacy Policy and as required by applicable law — and in no case for less than one year. When we no longer need it, we delete or de-identify it. How long we keep information depends on factors such as whether we need it to provide the Store, maintain your account, complete transactions, comply with legal and tax obligations, resolve disputes, and enforce our agreements.

Security of Your Information

We use reasonable administrative, technical, and organizational measures designed to protect personal information collected through the Store. However, no security measures are perfect, and information transmitted over the internet may not be fully secure. If we become aware of a security incident affecting your personal information, we will notify you and the relevant authorities as required by applicable law.

Depending on where you live, you may have some or all of the following rights regarding your personal information. These rights are not absolute and may apply only in certain circumstances:

To exercise any of these rights, contact us at admin@vimocity.com. We may need to verify your identity before processing your request, and you may use an authorized agent to submit a request on your behalf. We will respond within the time required by applicable law.

You can opt out of promotional emails using the unsubscribe link in our emails, and out of promotional texts by following the instructions in those messages. Even if you opt out, we may still send non-promotional messages about your account, orders, or policy updates.

Additional Disclosures for U.S. State Residents

Residents of states with comprehensive privacy laws — including California, Virginia, Colorado, Connecticut, and Utah, and other states as their privacy laws take effect — may have the rights described above, and may also have the right to opt out of the sale or sharing of personal information and of targeted advertising. As stated above, Vimocity does not sell or share personal information and does not use it for targeted advertising.

We collect this information from the sources, and use and disclose it for the purposes, described in this Privacy Policy. If we decline to act on a request, you may appeal by contacting us at admin@vimocity.com; you may also contact your state attorney general.

International Users

The Store is operated from the United States. If you access the Store from outside the United States, your personal information will be transferred to and processed in the United States, which may have different data protection laws than your country.

If you are in the European Economic Area or the United Kingdom, Vimocity is the controller of your personal information and processes it to perform our contract with you (to fulfill your orders), for our legitimate interests (to improve and secure the Store and prevent fraud), with your consent (for certain cookies and marketing), and to comply with legal obligations. You may access, correct, delete, restrict, or port your information, object to certain processing, withdraw consent, or lodge a complaint with your local supervisory authority. Where we transfer personal information out of these regions, we rely on recognized safeguards such as the Standard Contractual Clauses.

Children’s Privacy

The Store is not intended for children, and we do not knowingly collect personal information from children under the age of majority in their jurisdiction. We do not sell or share the personal information of consumers under 16 years of age. The Store may contain links to websites operated by third parties, including brand partners and social media platforms. We are not responsible for their privacy practices. We encourage you to review their privacy policies before providing them with personal information.

We may update this Privacy Policy from time to time to reflect changes to our practices or for legal or regulatory reasons. When we do, we will post the revised policy on the Store and update the “Last updated” date above.
